  1. Defined Terms

    Save as amended in this privacy policy, words and expressions defined in the SSC and in the NEMO Portal Terms of Use and used in this privacy policy shall have the meaning set out in the SSC and the NEMO Portal Terms of Use (as applicable).

  2. Our approach to privacy

    1. Storengy UK Limited ("Storengy UK", "us", "we", or "our") operates the NEMO Portal using our website at https://nemo.storengy.co.uk/.

    2. We are committed to protecting your privacy. This privacy policy sets out how we collect, store, process, transfer, share, and use data that identifies or is associated with you ("personal information").

    3. Storengy UK is the data controller of personal information we hold about you.

  3. Personal information we collect about you and how we use it

    1. We collect personal information about you when you voluntarily submit information directly to us when you use the NEMO Portal or otherwise in relation to the Storage Services. This can include information you provide to us when you register for an Account, send messages using the NEMO Portal, perform transactions on the NEMO Portal, or use some other feature of the NEMO Portal.

    2. We also collect personal information from you indirectly, such as information about the pages you look at on the NEMO Portal, the searches that you make on the NEMO Portal, and the device you use to access the NEMO Portal.

    3. The list below sets out the categories of personal information we collect about you and how we use that information:

      • Contact details: We will ask you (or the Customer) to provide your name and email address when you create an Account on the NEMO Portal. We will use your contact details to create an Account for you so that you can use the NEMO Portal, to communicate with you directly about the NEMO Portal, the Storage Services, each of our rights and obligations under the SSC, and about any queries, issues or concerns you or other users have, and to send you marketing communications in accordance with your preferences. Your contact details may be made available to other users of the NEMO Portal in connection with the Storage Services.

      • Other profile information: Where appropriate, you can complete your profile by submitting other information such as your telephone number and address. We use the information in your profile to provide the Storage Services and access to the NEMO Portal, to you, and in the performance of our rights and obligations under the SSC. Your profile information may be made available to other users of the NEMO Portal in connection with the Storage Services.

      • Comments and opinions: When you contact us directly, e.g. by email, telephone, post, or through the NEMO Portal, we will record your comments and opinions. We will use your comments and opinions to address your queries, issues, and concerns, and to improve our products and services. We may also use comments and opinions you express when responding to surveys to determine products and services that may be of interest to you and to send you marketing communications in accordance with your marketing preferences.

      • Your preferences: We hold information about the preferences you set for notifications, marketing communications, and how the NEMO Portal is displayed. We will use your preference settings for the purpose of providing notifications, sending marketing communications, and displaying the NEMO Portal in accordance with your choices.

      • Information about how you use and connect to the NEMO Portal: We collect information about how you use the NEMO Portal, such as the pages you view on the NEMO Portal, the time you access the NEMO Portal, and how long you use it for, the website from where you came to the NEMO Portal or go to after leaving the NEMO Portal, and any selections and choices you make when using the NEMO Portal.

        We also collect information about the computer, tablet, smartphone or other electronic device you use to connect to the NEMO Portal. This information can include details about the type of device, unique device identifying numbers, operating systems, browsers and applications connected to the NEMO Portal through the device, your Internet service provider or mobile network, your IP address and your device’s telephone number (if it has one).

        We use information about how you use and connect to the NEMO Portal to present the NEMO Portal to you on your device and to determine products and services that may be of interest to you for marketing purposes.

      • Information about your location: Other than information you choose to provide to us, we do not collect information about your precise location. Your device’s IP address may help us determine an approximate location. We may use an approximate location to ensure content on the NEMO Portal is relevant to the city, state or country you are using your device in.

      • Information about fraudulent or criminal activity relating to your Account: We will use information about fraudulent or criminal activity relating to your use of the NEMO Portal for the purposes of detecting and preventing fraud or crime.

      • All personal information: We will use all the personal information we collect to monitor and improve the NEMO Portal, our products and services, and our business. We also use the personal information we collect to help us develop new products and services. Our use of your personal information in this way will not result in information that was not previously publicly available being made public on the NEMO Portal.

    4. At various places on the NEMO Portal you may be requested to enter certain personal information. Personal information that must be provided to use the requested services will be indicated at the time of collection.

    5. We may anonymise and aggregate any of the information we collect (so that it does not directly identify you). We may use anonymised information for purposes that include testing our IT systems, research, data analysis, improving the NEMO Portal and our products and services, and developing new products and features.

  4. Disclosure of personal information

    1. We may share your personal information with the following parties:

      • Companies in the same group of companies as us: Our subsidiaries (i.e. any organisation we own or control), or our holding company or ultimate holding company (i.e. any organisation that owns or controls us), and any subsidiaries they own. These companies will only use your personal information to provide a service to us or to you in the same way as we are permitted to do under this privacy policy.

      • Selected third parties: With your permission, we may share your contact details with selected third parties so that they can provide you with information about products and services that they believe may be of interest to you.

      • Service providers and advisors: Third parties who provide a service to us. For example, we may use third parties to provide the Storage Services to you (in accordance with the SSC), send out marketing information to you on our behalf, help support our IT infrastructure, process payments from and to you on our behalf, develop analytical information for us about our services and provide professional services such as legal and accountancy services. These third parties will only be allowed to use your personal information to assist us and will be required to keep your information secure.

      • Purchasers of our business: Personal information may be disclosed or transferred to buyers or prospective buyers of our business or any of our assets as part of any such sale.

      • Law enforcement, regulators, and other parties for legal reasons: Third parties who we are under a legal obligation to disclose your personal information to, or to whom we need to disclose your personal information to protect our rights, property, or safety, or to protect the rights, property, or safety of others. We may also disclose personal information to third parties to help detect and investigate illegal activities and breaches of any agreement we have with you.

    2. We do not disclose personal information about identifiable individuals to anyone else except as set out above. We may provide third parties with aggregate statistical information and analytics about our customers and users of the NEMO Portal, but we will make sure no one can be identified from this information before we disclose it.

  5. Marketing and advertising

    1. From time to time we may contact you with information about our products and services. Most marketing messages we send will be by email. For some marketing messages, we may use personal information we collect about you to help us determine the most relevant marketing information to share with you. If you do not want to receive marketing messages from us, you will usually be able to tell us by selecting certain boxes on forms we use when we first collect your contact details. You can also change your marketing preferences at a later date by clicking on the unsubscribe link at the bottom of our marketing emails.

    2. Where you have given us permission to do so, we may share your contact details with selected third parties so that they can provide you with information about products and services that they believe may be of interest to you.

    3. If you decide you no longer want us to share your contact details with selected third parties for marketing purposes, you can let us know by contacting us using our contact details in the SSC.

  6. Storing and transferring your personal information

    1. Security: We implement appropriate technical and organisational measures to protect your personal information against accidental or unlawful destruction, loss, change or damage.

    2. International Transfers of your Personal Information: The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in. Some of these jurisdictions offer differing levels of protection in respect of personal information and may, in certain instances, be less protective than the jurisdiction you are typically resident in. We will take reasonable steps to ensure that your personal information is treated securely and in accordance with applicable law and this privacy policy.

  7. Accessing and correcting your personal information

    1. You have the following rights in relation to your personal information: (a) the right to be informed about how your personal information is being used; (b) the right to access the personal information we hold about you; and (c) the right to request the correction of inaccurate personal data we hold about you and to request the blocking or deletion of your personal information where the processing does not comply with local data protection laws.

    2. To exercise any of the above rights, or if you have any questions relating to your rights, please contact us by using the details set out in the SSC. Please provide as much information as you can about the personal information you are looking for and we will be happy to try and help you find or correct it.

  8. Links to third party sites

    Our Service may, from time to time, contain links to and from third party websites, including those of other users, our partner networks, advertisers, partner merchants, news publications, retailers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.

  9. Changes to this privacy policy

    We may update this privacy policy from time to time and so you should review this policy periodically. When we change this privacy policy in a material way, we will update the “Updated” date at the end of this privacy policy. Changes to this privacy policy are effective when they are posted on this page.
